			<content:encoded><![CDATA[<p>Today, the United States Court of Appeals for the Ninth Circuit issued a ruling in <em>Perry v. Brown</em> upholding the historic August 2010 decision of the Federal District Court that found Proposition 8 <span style="text-decoration: underline;">unconstitutional</span>.  In an opinion authored by Judge Stephen Reinhardt,  the Ninth Circuit concluded that Proposition 8 violates the Equal  Protection Clause of the Fourteenth Amendment to the United States  Constitution.  Proposition 8 stripped gay and lesbian Californians of  the fundamental freedom to marry.</p>
<p>&#8220;Proposition 8 serves no purpose, and has no effect in California,  other than to lessen the status and human dignity of gays and lesbians  in California, and to officially reclassify their relationships and  families as inferior to those of opposite-sex couples.  The Constitution  simply does not allow for laws of this sort,&#8221; Judge Reinhardt wrote.</p>

<p>The American Foundation for Equal Rights (AFER) is the sole sponsor of the <em>Perry</em> case.</p>
<p>&#8220;Today the Ninth Circuit Court of Appeals affirmed, as the courts  have repeatedly throughout our nation&#8217;s history, that singling out a  class of citizens for discriminatory treatment is unfair, unlawful and  violates basic American values,&#8221; said AFER Board President Chad Griffin.   &#8221;Like many other Americans, our plaintiffs want nothing more than to  marry the person they love.  Committed, loving couples and their  families should not be denied this most fundamental freedom.&#8221;</p>

			<content:encoded><![CDATA[<p>Today, thanks to the efforts of many grassroots organizations, discharged soldiers, politicians and those who just believe that all Americans deserve equal treatment, the Don&#8217;t Ask Don&#8217;t Tell policy was finally repealed when President Obama signed the bill into law.    The signing paves the way for members of our armed forced who were previously discharged under the DADT policy to formally re-enlist as well as opening the doors to allow those currently serving to step out of the shadows of the policy that forced them to live in hiding and fear.</p>
<p>Before signing the Bill, President Obama delivered a speech filled with poignant remarks and humor.    At one point in the speech he quoted a special operations warfighter&#8217;s remarks during the Pentagon&#8217;s review, &#8220; This was one of my favorites&#8221;, Obama stated, &#8220; it echoes the experience of Lloyd Corwin decades earlier:  &#8216;We have a gay guy in the unit.  He’s big, he’s mean, he kills lots of bad guys. No one cared that he was gay.&#8217;  (Audience laughter) And I think that sums up perfectly the situation.&#8221; (Applause.)</p>
<p>At the end of the speech and immediately before signing, President Obama had the following to say, &#8220;For we are not a nation that says, &#8216;don’t ask, don’t tell.&#8217; We are a nation that says, &#8216;Out of many, we are one.&#8217;  We are a nation that welcomes the service of every patriot.  We are a nation that believes that all men and women are created equal.   Those are the ideals that generations have fought for.  Those are the ideals that we uphold today.  And now, it is my honor to sign this bill into law.&#8221;</p>
<p>Today is a day for the history books.  A day that we hope is just one of many historic moments for the LGBT community to come.</p>

			<content:encoded><![CDATA[<p>The Anti-Defamation League (ADL) urged the United States Court of Appeals for the Ninth Circuit to uphold a lower court ruling finding the California ban on same-sex marriage unconstitutional.  The League filed an amicus brief in the case, <em>Perry v. Schwarzenegger</em>.</p>
<p>ADL issued the following statement:</p>
<blockquote><p>The segregated system of domestic partnership and marriage created by  Proposition 8 unfairly forces gays and lesbians to disclose their  sexual orientation in order to qualify for state benefits, thereby  raising serious privacy concerns.</p>
<p>By compelling individuals to disclose this personal and private  information the system created by Proposition 8 demeans the entire  community&#8217;s dignity and, at a time when bullying, harassment and hate  crimes are prevalent, may expose gay individuals to discriminatory  treatment or worse by those who continue to harbor prejudices.</p>
<p>California&#8217;s ban on same-sex marriage  is an affront to personal liberty and equal protection of law, and we  urge the 9th Circuit to find it unconstitutional.</p></blockquote>
<p>The 9th Circuit will hear arguments in the case on December 6, 2010, in San Francisco.  The League&#8217;s <a href="http://www.adl.org/civil_rights/ab/3743102-ADL-Amicus-Brief-Perry-v-Schwarzenegger.PDF">brief</a> was drafted by the law firm Quinn Emanuel Urquhart &amp; Sullivan, LLP – Redwood Shores, California office.  ADL has regional offices in Los Angeles, Orange County, Santa Barbara, San Diego and San Francisco.</p>

			<content:encoded><![CDATA[<p>Many couples who hoped to finally hear wedding bells on Wednesday were disappointed and saddened yesterday when the 9th District Court of Appeals issued an indefinite hold on the ruling by Judge Vaughn Walker which ruled Prop 8 unconstitutional.   Many thought that the courts would allow the marriages to begin on Wednesday due to the fact that both Governor Arnold Schwarzenegger and Attorney General Jerry Brown both supported Judge Walkers decision.   Jerry Brown sent out a message on Twitter yesterday after the hold was announced, &#8216;<span><span>Appeals court  grants motion extending stay, hearing set for week of 12/6.  “Fall seven  times, stand up eight.” &#8211; Japanese Proverb&#8217;.</span></span></p>
<p>The 9th Circuit Court of Appeals agreed to expedite the case, scheduling  arguments on Dec. 6.    &#8220;We are very gratified that the 9th Circuit has  recognized the importance and the pressing nature of this case,&#8221; said  lawyer Ted Boutros.    In the meantime those waiting to wed may have to wait for quite some time.<span><span> <a href="http://www.sandiego6.com/news/local/story/Same-Sex-Marriages-on-Hold-Until-At-Least-December/Rq9hHxtr-Uy6PG6NfO8kvQ.cspx" target="_blank">San Diego 6</a> interviewed California Western School of Law Professor Barbara Cox who made the following statement:</span></span></p>
<blockquote><p><span><span> </span></span>&#8220;I would say we&#8217;re are at least a year away,&#8221; says California  Western School of Law Professor Barbara Cox.  &#8221;I would be very surprised  if they&#8230;didn&#8217;t stay it again,&#8221;</p>
<p>Even though the district  judge found no legal basis for banning gay marriage, Cox says he is  certainly aware there is a good chance the 9th Circuit will hear the  case. &#8220;Why let people start to marry now when they could have those  marriages voided and we already went through that once with the San  Francisco marriages.&#8221;</p>
<p>Cox cautions those who want to ban gay  marriage in California that legal challenges to the higher court could  make it open to all the states in the 9th Circuit if that court makes a  similar finding to the U.S. District Judge&#8217;s decision.  Further legal  challenges could expand gay marriage to even more of the country.</p>
<p>&#8220;By  trying to prevent marriage in California, if it goes to the Supreme  Court, they lose all the marriage bans that exist now. I think that is a  big risk for them to take,&#8221; says Cox.</p>
<p>Cox says if the legal  battle goes to the Supreme Court, same-sex marriages would likely be  delayed at least three years if they were allowed at all.</p></blockquote>

		<title>Legal Battle Over Prop 8 Resumes Today in US District Court</title>

			<content:encoded><![CDATA[<p>Beginning this morning, the legal battle over Prop 8 will resume, this time on a Federal level, before Chief U.S. District Judge Vaughn Walker, who will consider a lawsuit challenging Proposition 8, the 2008 voter-approv<a href="http://shoutlongbeach.com/wp-content/uploads/2009/05/475-home-rally-crowd.jpg"></a>ed initiative that restored California&#8217;s ban on same-sex marriages.   With this challenge, the legal fight over gay marriage shifts into unprecedented territory becoming the first trial ever held over the constitutionality of a state&#8217;s ban on the right of same-sex couples to wed.   Many in the legal community believe the trial may lay the groundwork for eventually propelling the gay marriage issue to the U.S. Supreme Court. </p>
<p>Kristin Perry and Sandra Stier along with Jeffrey Zarrillo and Paul Katami are the two long term couples who have brought this case before the court, arguing that California&#8217;s ban on gay marriage is unconstitutional. They are asking Chief Judge Vaughn R. Walker to issue an injunction against Prop 8&#8242;s  enforcement.    Representing them are two high-powered attorneys, Theodore B. Olson and David Boies,  who have come together from previous opposing sides (the famous &#8220;hanging chads&#8221; case in Florida) to argue in favor of same sex marriage before the US District Court in San Francisco. </p>
<p>Many experts believe that the case will likely end up in the United States Supreme Court, irregardless of the outcome of the trial which begins today in California.    The case is expected to set legal precedents that will shape society for years to come and result in a landmark court decision that settles whether Americans can marry people of the same sex. </p>
<p>After the last legal defeat for Prop 8 opponents when challenged California State court last year and the current grass roots battle over whether to take the issue to vote again in 2010 vs 2012, emotions and opinions are high running high within the gay and lesbian community.     While many support the couples who have brought these issues before the US District Court, there are many who feel that the challenge is a mistake.  Paul Hogarth of the <a href="http://www.huffingtonpost.com/paul-hogarth/prop-8-trial-starts-today_b_418325.html" target="_blank">Huffington Post </a>wrote, &#8220;For years, civil rights groups had carefully kept the federal courts out of gay marriage fights &#8211; and the prominent lawyers in <em>Perry</em> filed the suit without consulting them. But with most of marriage&#8217;s legal benefits coming under federal law, it was only a matter of time before the federal courts weighed in on this issue. The trouble is that a wiser battle to start with would challenge the Defense of Marriage Act (DOMA) &#8211; and in fact, there are such efforts in place.&#8221;</p>
<p>In another unprecedented move, Judge Vaughn has ruled that the trial will be videotaped and distributed over the Internet, something that is rarely done in Federal cases.    Unlike other cases regarding marriage, the Judge is set to allow weeks of testimony from scholars, same sex partners and opponents.   Proposition 8 campaign attorney Andy Pugno was quoted in the LA Times as saying &#8220;Actually putting witnesses on the stand has never been done before in any lawsuit claiming a right to same-sex marriage. So this is a very out-of-the-ordinary approach.&#8221;    This out-of-the-ordinary approach is making Prop 8 supporters uncomfortable  (so uncomfortable that they filed a last minute unsuccessful injunction to stop the taping) about having to make public statements in front of millions of viewers online as to why they believe same sex marriage should not be allowed.    Prop 8 opponents on the other hand believe that the taping offers an opportunity to educate the public regarding the issues surrounding this case.</p>

			<content:encoded><![CDATA[<p style="font-family: Times New Roman;"><span style="font-size: small;">WASHINGTON, D.C. – Today, Congressman Jerrold Nadler (D-NY), Chair of the House Judiciary Subcommittee on the Constitution, Civil Rights and Civil Liberties, Congresswoman Tammy Baldwin (D-WI) and Congressman Jared Polis (D-CO), along with Congressman John Conyers (D-MI), Congressman John Lewis (D-GA), Congresswoman Nydia Velazquez (D-NY) and Congresswoman Barbara Lee (D-CA), with a total of 91 original co-sponsors to date, introduced the Respect for Marriage Act in the House of Representatives.  This legislation would repeal the Defense of Marriage Act (DOMA), a 1996 law which discriminates against lawfully married same-sex couples.</span></p>
<p>The 13-year-old DOMA singles out legally married same-sex couples for discriminatory treatment under federal law, selectively denying them critical federal responsibilities and rights, including programs like social security that are intended to ensure the stability and security of American families.</p>
<p style="font-family: Times New Roman;"><span style="font-size: small;">The Respect for Marriage Act, the consensus of months of planning and organizing among the nation’s leading LGBT and civil rights stakeholders and legislators, would ensure that valid marriages are respected under federal law, providing couples with much-needed certainty that their lawful marriages will be honored under federal law and that they will have the same access to federal responsibilities and rights as all other married couples.<br />
</span></p>
<p style="font-family: Times New Roman;"><span style="font-size: small;">The Respect of Marriage Act would accomplish this by repealing DOMA in its entirety and by adopting the place-of-celebration rule recommended in the Uniform Marriage and Divorce Act, which embraces the common law principle that marriages that are valid in the state where they were entered into will be recognized.  While this rule governs recognition of marriage for purposes of federal law, marriage recognition under state law would continue to be decided by each state. </span></p>
<p style="font-family: Times New Roman;"><span style="font-size: small;"><br />
The Respect for Marriage Act would not tell any state who can marry or how married couples must be treated for purposes of state law, and would not obligate any person, church, city or state to celebrate or license a marriage of two people of the same sex.  It would merely restore the approach historically taken by states of determining, under principles of comity and Full Faith and Credit, whether to honor a couple’s marriage for purposes of state law. </span></p>
<p style="font-family: Times New Roman;"><span style="font-size: small;"><br />
Supporters of DOMA argued in 1996 that the law is necessary to promote family structures that are best for children, but every credible medical, social science and child welfare organization has concluded that same-sex couples are equal parents.  Married gay and lesbian couples pay taxes, serve their communities and raise children like other couples.  Their contributions and needs are no different from those of their neighbors.  The Respect for Marriage Act would ensure that couples who assume the serious legal duties of marriage are treated fairly under federal law.</span></p>
<p style="font-family: Times New Roman;"><span style="font-size: small;"><br />
The introduction of the Respect for Marriage Act responds directly to a call from President Obama for Congressional action on the issue.  As the President recently confirmed:  “I stand by my long-standing commitment to work with Congress to repeal the so-called Defense of Marriage Act.  It’s discriminatory, it interferes with States’ rights, and it’s time we overturned it.” </span></p>
<p style="font-family: Times New Roman;"><span style="font-size: small;"><br />
Standing with the Members of Congress today were couples who have been harmed by DOMA, numerous members of the clergy, and many of the nation’s leading LGBT and civil rights organizations – including Human Rights Campaign, Lambda Legal, the National Gay and Lesbian Task Force, Freedom to Marry, the American Civil Liberties Union, the National Center for Lesbian Rights, People for the American Way, and the National Organization of Women.  Also supportive of this legislation, and of this particular strategy for repealing DOMA, are the Gay &amp; Lesbian Advocates &amp; Defenders (GLAD), who are leading the litigation efforts challenging DOMA in Gill v. Office of Personnel Management.</span></p>
<p style="font-family: Times New Roman;"><span style="font-size: small;"><br />
“The full repeal of DOMA is long overdue,” said Rep. Nadler.  “When DOMA was passed in 1996, its full harm may not have been apparent to all Members of Congress because same-sex couples were not yet able to marry.  It was a so-called ‘defense’ against a hypothetical harm.  This made it easy for our opponents to demonize gay and lesbian families.  Now, in 2009, we have tens of thousands of married same-sex couples in this country, living openly, raising families and paying taxes in states that have granted them the right to marry, and it has become abundantly clear that, while the sky has not fallen on the institution of marriage, as DOMA supporters had claimed, DOMA is causing these couples concrete and lasting harm.  Discrimination against committed couples and stable families is terrible federal policy.  But, with a President who is committed to repealing DOMA and a broad, diverse coalition of Americans on our side, we now have a real opportunity to remove from the books this obnoxious and ugly law.”</span></p>
<p style="font-family: Times New Roman;"><span style="font-size: small;"><br />
“In support of families throughout the nation, our legislation will extend to same-sex, legally married couples the same federal rights and recognition now offered to heterosexual married couples, nothing more, nothing less,” said Rep. Baldwin, Co-Chair of the Congressional LGBT Equality Caucus.  “As we continually strive to form a more perfect Union, repealing DOMA is a necessary step toward full equality for LGBT Americans.”</span></p>
<p style="font-family: Times New Roman;"><span style="font-size: small;"><br />
“No one should be denied the opportunity to choose his or her spouse,” said Rep. Polis.  “It is a basic human right and deeply personal decision.  Throughout history, we have only moved forward when society has distinguished between traditional values and valueless traditions.  The Defense of Marriage Act – DOMA – is a valueless tradition that undermines the spirit of love and commitment that couples share and sends the wrong message to society.  It is time for its repeal.”</span></p>

“Respecting the dignity of every human being and the people’s right to freely make decisions about their own lives is in keeping with the most sacred and fundamental principles of our democracy,” said Rep. Lewis.  “That is what made the Defense of Marriage Act so wrong.  From the founding of this nation, we made exceptions to this high moral mandate, and as our history shows, it has always led to the gravest injustice.  Before we travel too far down the wrong path, we must right this wrong.  We must repeal DOMA and put in its place federal action that restores the integrity of our democracy.  Over the years, thousands have paid the price to make this a more open, inclusive society.  We must not turn back.  We must progress to that point where we seek to build a national community at peace with itself.”</span></p>

“The so called Defense of Marriage Act is discriminatory and unfair and denies fundamental civil liberties to countless families across America,” said Rep. Lee.  “Gay, lesbian and transgendered Americans deserve nothing less that equal protection under the law.”</span></p>

“The Defense of Marriage Act (DOMA) is a hurtful and cynical law enacted to discriminate against loving, committed same-sex couples.  It does real harm by denying thousands of lawfully-married same-sex couples the federal rights and benefits that only flow through marriage.  Many of these include the protections couples turn to in times of need, like Social Security survivors’ benefits, medical leave to care for an ailing spouse and equal treatment under U.S. immigration laws.  Today’s introduction of legislation to repeal DOMA is a welcome step, and as more states recognize the commitment of loving same-sex couples and their families, it&#8217;s time for this law to go into the history books where it belongs,” said Joe Solmonese, President of the Human Rights Campaign.</span></p>

“DOMA is and has always been an immoral attack on same-sex couples, our families and our fundamental humanity.  This hateful law has only served to discriminate against people and belittle our nation&#8217;s heralded values of freedom, fairness and justice. It is long past time to repeal DOMA, which has left a moral scar on this country.  We thank Reps. Nadler, Baldwin and Polis for taking this step toward closing an ugly chapter in our country&#8217;s history, and for working to ensure same-sex couples and our families are treated fairly,” said Rea Carey, Executive Director of the National Gay and Lesbian Task Force.</span></p>

“So-called ‘DOMA’ was a radical departure from the way federal government has treated married couples throughout most of American history.  It makes more sense to respect marriages than to destabilize them.  In America, we don’t have second-class citizens and we shouldn’t have second-class marriages either,” said Evan Wolfson, Executive Director of Freedom to Marry and author of Why Marriage Matters: America, Equality and Gay People&#8217;s Right to Marry.</span></p>

“It is long past time for DOMA to go.  When DOMA passed in 1996 it was a gratuitous slap in the face.  But now, 13 years later, there are thousands of married same-sex couples who are hurt by this law.  We&#8217;ve come a long way in 13 years and the federal government shouldn&#8217;t be in the business of deciding that some married couples are worthy of federal respect and others are not.  Married same-sex couples pay federal taxes just like everyone else and have a right to the same important benefits and protections as everyone else,” said Kevin Cathcart, Executive Director at Lambda Legal.</span></p>
